Understanding the legal environment for LGBTQ+ individuals in Sri Lanka
Sri Lanka still maintains Section 365 and 365A of the Penal Code, colonial-era laws inherited from the British that criminalize "unnatural offences" and "acts of gross indecency." However, these laws are rarely enforced in private, consensual situations between adults.
Technically Illegal But Rarely EnforcedIn 2016, Sri Lanka recognized the right to change legal gender following medical intervention. The government has issued directives to recognize transgender individuals' preferred gender on official documents, though implementation remains inconsistent.
Partially RecognizedWhile legal protections are limited, Sri Lankan society is generally tolerant in tourist areas. Discretion is advised in rural areas. The tourism industry, particularly high-end hotels and resorts, is welcoming to LGBTQ+ guests.
Tolerant in Tourist AreasWhile prosecution of private, consensual same-sex activity between adults is extremely rare, public displays of affection (regardless of sexual orientation) are generally frowned upon in Sri Lankan culture. We recommend exercising discretion in public spaces, particularly outside of major tourist areas and international hotels.
